This Privacy Policy covers the website vates-sports.com and the Vates Sports app for iPhone (together, the "Service"). Both are operated by Marin Baudinet-Barrès ("we", "us", "our"), acting as data controller within the meaning of the General Data Protection Regulation (EU) 2016/679 (GDPR). The website and the app are two ways into the same Service: one account works in both, and everything in this policy applies to both unless a paragraph says otherwise.

We do not collect: payment information, precise or GPS location, phone numbers, or any other data not listed above. Optional advertising measurement on the website uses X only after your separate consent, as explained below. We do not send our PostHog analytics records to X. Your email address, your favourites and your individual calls are never published. Your own calls and results are visible only to you while you are signed in.
The leaderboards (weekly and seasonal) are public, including to visitors who are not signed in. Each row shows a points total and the number of calls made, identified either by your public profile (below) or, if your profile is private, only by your member number (or as Private player, depending on the interface) next to a default avatar that is the same for every private member.
We do not publish a directory of members, and there is no way to search for a member.
Accounts created on or after October 21, 2026 have a public profile by default. The registration form says so and lets you keep your profile private from the start. Accounts created before that date stay private (member number only) unless the member turns their public profile on; we never switch it on for them.
While your profile is public, anyone, including visitors who are not signed in, can see: your username, your member number, the avatar, banner and row style you chose, your bio if you wrote one, and your season totals (points, calls made, calls awaiting a result, and how many of your scored calls were right or wrong). Your username and avatar identify your leaderboard rows, which link to your profile page. Because your member number is shown next to your username, leaderboard rows from before your profile became public can also be linked to you. Your email address, your favourites and your individual calls (which games, players, sides or numbers you chose) are never shown.
A username that looks like an email address, a phone number or a web address is never shown: your row then shows your member number until you change it.
We ask search engines not to index profile pages and we do not list them in our sitemap, but anyone who sees a public page can copy or share it. Do not put your real full name, contact details or anything else you want to keep private in your username or bio.
You can make your profile private at any time in Account settings, in one step, and without giving a reason. We then stop showing your username, avatar, bio and profile page straight away, and your rows show your member number again. This does not affect your account, your calls or your points. It does not undo what was shown while your profile was public, and copies other people made are outside our control.
Usernames and bios are not checked before they appear. We remove one that breaks the profile rules in the Terms (section 5) or the law when we become aware of it, and we tell you why by email. Anyone can report a profile from its page or by writing to [email protected].
Your public profile is shown only on vates-sports.com and in the Vates Sports app. We do not use it anywhere else, for example in our social-media posts, without asking you first.
Legal basis: for accounts created on or after October 21, 2026, our legitimate interest (Art. 6(1)(f)) in running a game whose players can recognise each other on the leaderboards. Your username is a name you choose for that purpose, and you can object at any time, without reason, by making your profile private (Art. 21). For accounts created earlier, your consent (Art. 6(1)(a)), given when you turn your public profile on and withdrawn when you make it private (Art. 7(3)). Nothing is given for being public or taken away for being private.
We do not sell your personal data. We use the following providers to operate the Service. Optional X advertising measurement is a separate disclosure to X, described below, and only takes place with your consent:
While your profile is public, the items listed under "Public profile" can be seen by anyone who visits the site or uses the app. That is display to the public, not sharing with a provider.
Some providers may process data on servers located outside the European Economic Area (Cloudflare, Inc. operates globally). Your account database (Supabase) and, if you consent, your analytics data (PostHog EU Cloud) are hosted in the EU. Our data-processing server is in Canada, a country the European Commission recognises as providing an adequate level of protection for personal data (adequacy decision). Where data is transferred elsewhere outside the EEA, or accessed from outside it by a provider established elsewhere, appropriate safeguards apply, including Standard Contractual Clauses approved by the European Commission and/or the EU-US Data Privacy Framework.
The Service publishes information about NBA players: their names, teams, headshots and public game statistics, our projections, and our estimate of the chance each player takes part in an upcoming game. When that chance is low we may show a short reason. One such reason repeats the status (for example "Questionable") under which the NBA lists a player on its official public injury report. We show that status word only, and only until his next game is played; we never publish the nature of an injury or illness, or any other medical information. Our sources are public: mainly Basketball-Reference for statistics, ESPN for player photographs, and the NBA's official injury report. Game statistics are kept as a historical record; past status words are kept, with nothing else, for as long as they help us estimate future chances. We rely on our legitimate interest in publishing sports information and on the public's right to information about professional athletes' sporting activity (GDPR Art. 6(1)(f)). A player, or someone acting for him, can object or ask about this processing at [email protected].

You can edit or clear your bio and change your profile artwork in Account settings, and make your profile private there at any time, without giving a reason: that is how you object to its display (Art. 21) or withdraw your consent (Art. 7(3)). It does not affect your use of the game. You can also ask us to erase your profile.
We use two cookies that are strictly necessary and require no consent: a session cookie to keep you logged in, and a preferences cookie to remember your unit system (metric/imperial). Neither tracks you across other websites.
With your consent, given via the cookie banner or the analytics choice panel below, we also use PostHog (PostHog EU Cloud, hosted in Frankfurt, Germany) to measure aggregate site usage (pages viewed, tabs used, approximate country-level location, device type) and to understand our signup flow. Analytics is off by default and only activates if you choose "Accept all", choose "Analytics only", enable analytics in "Personalise", or click "Accept" in the analytics panel. (The cookieless page counting described above is separate: it stores nothing on your device, so it is not what the banner asks about.) You can change your mind at any time, and it takes no more effort than saying yes. The "Cookie settings" link in the footer of any page reopens the banner so you can accept or reject again. If your browser or an extension hides cookie banners, the same link brings you to the "Your analytics choice" panel just below this paragraph, which offers the same two options and is always available on this page. Rejecting stops analytics immediately and clears the identifier described below. Your choice itself is remembered in your browser's local storage (a single "granted" or "denied" value, written only once you choose), so that we do not ask again on every page; it is never sent to us. When active, PostHog stores a random identifier in your browser's local storage (not a cookie); until you consent, it stores nothing on your device. We keep this privacy-minimal: session replay is off, and we do not capture the contents of fields you type (such as your email or password). PostHog analytics and X advertising measurement are separate: consent to one does not authorise the other.
Your analytics choice
Off by default. Selecting "Accept all" or enabling "Advertising measurement (X)" in
"Personalise" allows the X Pixel on the public /projections/ and
/projections/day-leaders/ pages. "Analytics only" allows PostHog without X; "Essential only" refuses both. Essential features remain available with every choice.
You can allow either independently, or neither. Refusing has no effect on access, projections or your account.
The Pixel sends visit events, technical engagement signals, your IP address, browser/device information and advertising identifiers (including an ad click ID if present) to X for attribution and ad measurement. X may read or set cookies and associate these data with your X account. X may also use the information to improve its advertising services under its own Privacy Policy. The recipient is X Internet Unlimited Company for EEA users, with processing by X companies including X Corp. in the United States; X’s policy describes its international transfers and safeguards. This is not anonymous measurement. We do not create website retargeting audiences as part of this installation.
We disable automatic form matching, button capture and data-layer collection. We do not supply names,
email addresses, phone numbers, account IDs or individual game choices, and we use X’s
hide_page_location setting to omit page URLs and referrers from event parameters.
The Pixel is not loaded on account, sign-in, prediction-game or legal pages, nor in the iPhone app.
Your separate choice, timestamp and this notice version are kept in this browser for 180 days. A previous analytics opt-in does not grant X permission. Global Privacy Control, when enabled in your browser, is treated as a refusal of X measurement. You can withdraw through Cookie settings in any footer or the permanent panel below. Withdrawal stops future measurement; if the Pixel was loaded, the page reloads to unload it. This does not undo information X already received. For X’s own controls, see X advertising privacy settings.
Your X advertising measurement choice
Optional and separate from analytics. X receives projection-page visits, technical information and advertising identifiers. Your choice is remembered for 180 days. Refusing does not limit the website.
X measurement is off unless you have separately allowed it.
Requests your browser makes to other companies' servers. Independently of cookies, loading a page makes your browser fetch a few files from servers we do not run. Any such request necessarily reveals your IP address, the page you are on and your browser's user-agent string to whoever serves the file. That is normal for any site that loads a resource from a third party, but we would rather name them than leave you to find them:
cdn.jsdelivr.net): serves the authentication library the
site is built on.static.cloudflareinsights.com): a
cookieless audience-measurement script added by our hosting provider. It sets no cookie and
stores nothing on your device, which is why it is not part of the cookie banner; it counts
page loads and measures how fast pages render. Legal basis: our legitimate interest in knowing whether
the site works and is being read, Art. 6(1)(f).storage.ko-fi.com): serves the script and images behind our
"Support me on Ko-fi" button. It loads on every page, whether or not you click the button. Clicking it
opens ko-fi.com in a new tab; we do not embed Ko-fi content inside our own pages.fonts.googleapis.com): requested by Ko-fi's script, not
by ours. Every font this site uses is hosted on our own servers precisely so that reading a page does
not reach Google; Ko-fi's button is the one exception and we are working to remove it.Only after X advertising consent: your browser also contacts
static.ads-twitter.com for the Pixel and X measurement endpoints including

and t.co. These requests reveal technical information to X as described above;

For the other third-party resources listed above, we receive nothing back beyond the file itself, and we do not control what they do with what a request reveals to them. This list is meant to be complete as at the date at the top of this policy; if we add or drop one, we update it here.
The Vates Sports app for iPhone uses the same account and the same data as the website. It collects nothing the website does not. It contains no analytics, no advertising and no tracking of any kind, and no code from other companies: it connects only to our own servers and to our database provider, Supabase (see "Who we share your data with").
What the app stores on your iPhone. Three things, and only once you are signed in:
All of these are removed, with any notification still planned, when you sign out, when your session ends, or when you delete your account in the app. Deleting the app removes the appearance copy and the data copy at once, and iOS may also clear the data copy by itself when your iPhone is short of space. iOS can keep a Keychain item after an app is deleted, so the app clears any session left behind the first time it is opened after being installed again. Nothing else is written to your device: player photos are held in memory while the app is open and are not saved. None of these items tracks you or is shared with anyone. The first three are strictly necessary for something you asked for (staying signed in, seeing the appearance you chose, and opening the app without a connection), so they do not require your consent; notifications are only stored and sent after you turn them on and allow them in iOS.
Your account in the app. You can create an account in the app, with the same information and under the same Terms as on the website. You can delete it from the app (Account, then Delete account) as well as from the website's account settings; either way your account and the data attached to it are deleted everywhere. Your favourite team and player and your appearance are saved on your account, so they are the same in the app and on the website.
Pages you open from the app. Links in the app to our legal pages, our methodology or password reset open pages of vates-sports.com. Those pages are the website: this policy applies to them as to any visit, including the requests listed under "Requests your browser makes to other companies' servers".
Apple. You download the app from Apple's App Store (operated in the European Union by Apple Distribution International Ltd., Ireland), under Apple's own terms and privacy policy; Apple is responsible for what it collects when you do. Apple does not give us your identity. If you have allowed it in your iPhone's settings, Apple shares crash reports and aggregate usage statistics with app developers; we see them without being able to identify you. If we invite you to test a pre-release version through Apple's TestFlight, we give Apple your email address so that it can send the invitation, and Apple shares with us any feedback, screenshots and crash reports you choose to send. We use them only to fix the app and delete them once the problem they report is resolved.
Notifications. The app sends notifications only if you turn them on in the app and allow them in iOS. They are prepared and scheduled on your iPhone: we run no notification server, and no device token or notification address leaves your device. If we ever send notifications from our own servers, we will ask your permission first and update this policy before it starts.
Passwords are stored using bcrypt hashing and are never stored or transmitted in plain text. All communications between your browser and our servers use HTTPS encryption. We apply reasonable technical and organizational measures to protect your data.
No system can guarantee absolute security. In the event of a data breach affecting your rights, we will notify you and the CNIL within the legally required timeframe.
If we make significant changes to this Privacy Policy, we will notify registered users by email at least 15 days before the changes take effect. Continued use of the Service after the effective date means you have acknowledged the updated policy.

vates-sports.com and the Vates Sports app for iPhone (together, the "Service") are operated by Marin Baudinet-Barrès ("we", "us", "our"). The Service publishes statistical projections for NBA player performance, generated by a machine-learning model. It also offers a free prediction game in which you can call the outcome of upcoming games and earn points on a leaderboard (section 5). The Service is currently non-commercial and free to use.
The app. The website and the app are two ways into the same Service, and these Terms apply to both: one account works in both, and the game, its points and its leaderboards are the same. The app is distributed through Apple's App Store. Apple's standard licence for App Store apps (the Licensed Application End User License Agreement) governs your right to install and use the app software; these Terms govern the Service, your account and the game, in the app as on the website. Apple is not a party to these Terms, is not responsible for the Service or its content, and has no obligation to provide support for it: for any question or claim about the Service, contact us (section 12).
You must be at least 15 years old to create an account. By registering, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian is aware of and has authorized your use of the Service.
You are responsible for the security of your account and must:
You may hold only one account. We reserve the right to suspend or permanently terminate accounts that violate these Terms, without prior notice in cases of serious violation.
You may close your account at any time, for any reason and without giving one, from your account settings on the website or in the app. Doing so permanently deletes your account and the data attached to it, except the limited identification data the law requires us to keep for a year if your profile was public (see the Privacy Policy).
The Service is for personal, non-commercial use only. You agree not to:
The Service includes a free prediction game. You call the outcome of upcoming NBA games, and once those games have been played your calls are scored automatically and the points are added to public leaderboards. The game is run by us alone. Apple is not a sponsor of it and is not involved in it in any way, and neither is the NBA, any NBA team or any player.
Points are not money and never become money. They have no monetary value, no cash value and no value outside the Service. They cannot be bought, sold, traded, transferred between accounts, exchanged for anything, redeemed, withdrawn or cashed out, and they confer no ownership of anything. Nothing in the game is a stake, a bet or a wager: you never risk anything, and nothing you hold can be lost to another player. Taking part is free and always will be free; we do not sell points and there is nothing to buy.
The rules the game is scored by:
Your member number, your points total and the number of calls you have made appear on public leaderboards that anyone can read, including people who are not signed in. Your email address and your individual calls are not published. This is described in the Privacy Policy.
Public profile. If you created your account on or after October 21, 2026, your username, your bio and the avatar, banner and row style you pick are shown on the leaderboards and on a profile page anyone can open, unless you make your profile private, which you can do at registration or at any time in Account settings. Accounts created earlier stay private unless the member turns the profile on. Nothing in the game depends on it: no points, rewards or features are given for being public or taken away for being private. These rules apply to every username and bio:
Usernames and bios are not checked before they appear. Anyone can report a profile from its page or by writing to [email protected] with the page's address and the reason. We deal with reports promptly and tell the person who reported what we decided. If a username or bio breaks these rules or the law, we may hide it, make the profile private, or stop you from making it public again; we tell you our decision and the reason by email, and you can ask us to reconsider by replying. Hiding or removing a profile does not change your calls, points or ranks. We pass content that appears to threaten someone's life or safety to the authorities.
Using more than one account, automating calls, or otherwise manipulating a leaderboard is a breach of section 4. We may remove the points concerned, remove an account from the leaderboards, or terminate it.

We make no representation or warranty as to their accuracy. Actual NBA player performance will routinely and sometimes significantly differ from these projections.
Do not use these projections as the basis for placing bets, wagers, or any financial decision. We accept no responsibility or liability for any loss or damage, financial or otherwise, resulting from reliance on the projections published on this Service.
The machine-learning model, website code, design, and original content we create are our intellectual property. NBA player names, team names, and statistics used on the Service are either factual information in the public domain or used in a purely nominative/informational manner. This Service is not affiliated with, endorsed by, or sponsored by the National Basketball Association, NBA Properties, Inc., Sports Reference LLC, or any NBA team.
You may not reproduce, distribute, or create derivative works from our original content without prior written permission.
Open-source components included in the app, such as its typefaces (licensed under the SIL Open Font License 1.1), remain under their own licences, which the app lists under Account, then About.
We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free availability. We may modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice.
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Since the Service is provided free of charge, our total liability to you for any claim shall not exceed €1.
Nothing in these Terms excludes or limits our liability for death or personal injury, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, nothing in these Terms affects the rights the law of your country of residence gives you and does not allow to be signed away; where any part of this section conflicts with such a right, that right prevails and this section applies only as far as the law allows.
We may update these Terms, for example when a feature changes or the game's rules change. If a change materially affects your rights or obligations, we will tell registered users by email at least 15 days before it takes effect, and the change will not apply retroactively to calls you have already made. Minor corrections take effect when published. The date at the top of this section is always the date of the version in force. If you do not accept a change, you may close your account (section 3).
If any provision of these Terms is held to be invalid or unenforceable, the rest remains in force.
These Terms are governed by French law. If you are a consumer resident in another country of the European Union, this does not deprive you of the protection of the mandatory rules of the law of the country where you are habitually resident.
In the event of a dispute, we encourage you to contact us first at [email protected] to seek an amicable resolution. If no resolution is reached, the dispute may be brought before the competent French courts. If you are a consumer, you may bring proceedings before the courts of the country where you are resident, and we will only bring proceedings against you before those courts, in accordance with Articles 17 to 19 of Regulation (EU) No 1215/2012.
